Starting July 1, Virginia’s Clean Slate law will begin automatically sealing thousands of eligible criminal records, helping individuals move beyond past mistakes and build better futures for themselves and their families.
For many people, a low-level criminal conviction can create obstacles long after they have completed their sentence and turned their lives around. Employment opportunities, housing applications, and educational programs can all be affected by a record that may be years or even decades old. The Clean Slate law recognizes that people should not be punished forever for minor offenses when they have demonstrated rehabilitation and remained law-abiding citizens.
The law will automatically seal certain misdemeanor convictions, including offenses such as shoplifting, trespassing, disorderly conduct, and marijuana-related offenses, for individuals who have maintained a clean record for at least seven years. Others with eligible misdemeanor convictions, low-level felonies, and deferred dismissals may petition the court to have their records sealed after meeting the required waiting periods.
Research has consistently shown that stable employment and housing reduce the likelihood of future criminal activity. By removing unnecessary barriers, the Clean Slate law promotes rehabilitation, strengthens communities, and gives deserving individuals a genuine opportunity to succeed. Rather than allowing a single mistake to define a person’s future, the law encourages accountability, growth, and reintegration into society.
While sealed records will no longer be publicly accessible, they will remain available to law enforcement, courts, prosecutors, and certain employers in sensitive fields. The law strikes an important balance between public safety and the belief that people who have earned a second chance should be allowed to move forward.
As thousands of Virginians become eligible for record sealing, the Clean Slate law represents an important step toward a more fair and effective justice system—one that recognizes rehabilitation and rewards positive change.
