A new bill introduced by House Speaker Mike Moyle would make it a felony to speak “recklessly” about another person. The bill, which has already been presented to the House State Affairs Committee, would impose extreme penalties, including up to a $100,000 fine, five years in prison, or both for “communicating to a person. . . with reckless disregard as to whether or not the statement is false.” Tellingly, the bill will even permit prosecution if the statement pertains to state elected officials or employees in relation to their official duties. The bill is an absolute mess and an affront to the concept of a free society. The obvious concerns over potential First Amendment issues have been raised. If implemented the bill would radically alter the news we receive and would empower government to police every conversation.
