Yes, marijuana is still illegal in Idaho with no exceptions. Although most of our surrounding states have legalized marijuana to some extent, it remains a crime to possess any amount of marijuana in Idaho. Law enforcement can and do charge individuals for possession of marijuana, and driving under the influence of marijuana. Many people are caught with marijuana possession when they are involved in a traffic stop, such as speeding or running a stop sign. For example, the smell of marijuana emanating from a vehicle may give law enforcement cause to detain or arrest someone during a routine traffic stop.
In Idaho, possession of more than 3 ounces of marijuana is a felony, punishable by imprisonment of up to five years, and by fine of up to $10,000. Recently, the Idaho House passed a bill that would impose a mandatory $300 fine for anyone convicted of marijuana possession. The bill is currently in front of the Idaho Senate for consideration.
